Swimmy Swimming School Terms and Conditions
Article 1 (Definitions)
In these Terms and Conditions, the following terms shall have the meanings set forth below:
1. "School" refers to Swimmy Swimming School operated by Swimmy Inc.
2. "Member" refers to an individual who has agreed to these Terms and Conditions and has been approved for membership through procedures established by the School.
3. "Instructor" refers to a teaching professional affiliated with the School who provides swimming instruction.
Article 2 (Purpose)
The School aims to promote proper understanding of and interest in physical exercise through swimming, foster healthy physical and mental development, and contribute to the advancement of sports.
Article 3 (Membership Eligibility)
1. Prospective members must meet all of the following conditions:
(1) Meet the qualification requirements specified for each course
(2) Agree with the School's purpose
(3) Accept these Terms and Conditions
2. The following individuals cannot become or remain members:
(1) Members of organized crime groups or equivalent persons
(2) Individuals who may interfere with the smooth operation of lessons
(3) Other individuals deemed inappropriate for membership by the School
Article 4 (Membership Registration)
1. Prospective members must complete the following procedures:
(1) Submit a membership application form
(2) Pay the registration fee and initial membership fee
(3) Submit a medical certificate if required
2. Minors must obtain parental consent to become members. In such cases, the parent/guardian shall bear joint responsibility with the member under these Terms and Conditions.
Article 5 (Payment of Fees)
1. Members shall pay fees and other charges set by the School using the designated method.
2. The amount, payment date, and payment method of fees shall be separately specified by the School.
3. Paid fees are generally non-refundable.
Article 6 (Lessons and Instruction)
1. Lesson content and teaching methods shall be determined by the School's instructors.
2. For safety reasons, participants who do not follow instructor directions may be denied participation in lessons.
Article 7 (Facility Use and Safety)
1. Members shall observe the following when using facilities:
(1) Follow facility rules
(2) Comply with instructor directions
(3) Behave in a manner that does not compromise others' safety and comfort
2. The School shall not be liable for accidents or injuries during facility use except in cases of:
(1) Facility defects
(2) Intentional or gross negligence by the School
Article 8 (Disclaimer)
1. The School shall bear no responsibility for:
(1) Disputes between members
(2) Theft, loss, or damage of personal belongings
(3) Accidents resulting from members' pre-existing conditions or chronic illnesses
(4) Accidents caused by members' intentional acts or negligence
2. The School shall not be liable for injuries on premises unless caused by gross negligence of the School.
3. Members are responsible for managing their own health condition, and the School shall not be liable for accidents resulting from poor health.
Article 9 (Insurance)
1. Members below junior high school age must enroll in Sports Safety Association insurance category A1.
2. Members of high school age and above must obtain appropriate insurance coverage at their own responsibility.
Article 10 (Suspension and Expulsion)
The School may suspend or expel members without prior notice for:
1. Non-payment of fees for three or more months
2. Violation of these Terms and Conditions
3. Actions severely damaging the School's reputation
4. Causing harm to other members
5. Other actions significantly disrupting School order
Article 11 (Withdrawal)
1. Members wishing to withdraw must submit a designated withdrawal form.
2. Withdrawal forms must be submitted by the end of the month prior to the intended withdrawal month.
3. Any unpaid fees must be settled by the time of withdrawal.
Article 12 (Personal Information)
1. The School shall use members' personal information only for:
(1) Conducting and managing lessons
(2) Communicating with members
(3) Emergency response
2. Personal information will not be shared with third parties without consent unless required by law.
Article 13 (Photography and Social Media)
1. Photography and video recording during lessons are prohibited in principle.
2. Recording is permitted only for special events with School authorization.
3. Posting photos or videos on social media requires School permission.
Article 14 (Force Majeure)
The School shall not be liable if lessons cannot be conducted due to natural disasters, disease outbreaks, or other force majeure events.
Article 15 (Damages)
1. Members who cause damage to the School through violation of these Terms shall be liable for compensation.
2. Members shall pay actual costs for repair or replacement of damaged School facilities, equipment, or supplies.
3. Damages between members shall be resolved between the parties involved, with the School bearing no responsibility.
4. Compensation claims may include direct damages and incidental costs such as legal fees.
Article 16 (Amendment of Terms)
1. The School may amend these Terms and Conditions as necessary.
2. Members shall be notified of amendments one month in advance.
3. Notification shall be made through posting at the School and publication on the website.
Supplementary Provision
These Terms and Conditions shall take effect from March 1, 2025.
